1. Introduction

This Privacy Policy describes how Axis Stickhandling Inc. and Axis Hockey Inc. (together, "Axis", "we", "us" or "our") collect, use, disclose and retain personal information in connection with the Axis stickhandling training platform, the website at axisstickhandling.com and related services (together, the "Services"). It applies to players, their parents and guardians, coaches, individuals whom a coach invites to a team, mailing list subscribers and visitors to our website.

The Services are offered to residents of Canada other than residents of Quebec and are not offered in the United States. Use of the Services is also subject to the Customer Agreement available at app.axisstickhandling.com/terms. By creating an account or otherwise using the Services, you consent to the collection, use and disclosure of personal information as described in this Privacy Policy.

2. Children and parental consent

Many of the players who use the Services are minors. The account of a player under 16 years of age must be created by a parent or legal guardian, using the parent's or guardian's own email address, and that parent or guardian accepts the Customer Agreement and consents to this Privacy Policy on the player's behalf. A parent or guardian may contact us at any time to review or correct the personal information of a player in their care, to withdraw consent or to request that the account be deleted.

We do not permit a child under 13 years of age who appears to be located in the United States to create a player account. Our mailing list is intended for parents, coaches and players aged 13 and over, and a paid plan may be purchased only by a person aged 18 or over.

3. Personal information we collect

We collect personal information directly from users, automatically through their use of the Services and, in some cases, from other users or from our service providers. Depending on how the Services are used, it may include:

  • account and profile information, including an email address, date of birth, name, a display name for leaderboards, level of play, information identifying the link or campaign through which the account holder reached us and, where a player chooses to provide them, playing position, shooting side, jersey number, height and weight;
  • team information, including a coach's name and email address, the name, logo and membership of a team, requests to join it, and the names and email addresses of individuals whom a coach invites;
  • training information, including the drills and lessons a player completes, the portions of each training video played, the dates and times of sessions, training assigned by a coach, and the points, levels, badges and scores derived from that activity;
  • preference information, including the privacy and communication choices made for an account, the version of the Customer Agreement accepted and the date of each choice;
  • payment information, where a paid plan is purchased, including the plan and its price and dates, the accounts covered by a family plan, the billing email address, the card brand and last four digits, and the transaction records supplied by our payment processor, which may include the payer's name, email address and billing address;
  • mailing list information, including the email address submitted, the date of subscription and information identifying the link or campaign through which the subscriber reached us;
  • communications, including the content of messages sent to us and the contact details from which they are sent; and
  • technical information, including IP address, browser and device type, time zone, the country inferred from the IP address, and records of requests made to the Services.

Passwords are processed by our authentication provider and are not stored by Axis, and payment card numbers are collected directly by our payment processor and are not received by Axis. We do not ask for a telephone number, a photograph or a precise location, and the Services do not permit players to upload photographs or videos.

4. How we use personal information

We use personal information for the following purposes:

  • to create, authenticate and administer accounts and to confirm eligibility for the Services, including by determining a player's age and estimating the country from which an account is created;
  • to deliver the training program, to record and present a player's progress, and to award points, levels and badges;
  • to enable coaches to manage their teams, to invite players, to assign training and to review the training activity of players on their teams;
  • to operate team and public leaderboards;
  • to process payments and to administer paid plans, trials and renewals;
  • to send service communications, such as welcome messages, password resets, team invitations and billing notices, and, where the recipient has agreed to receive them, training-related messages and mailing list communications;
  • to respond to enquiries and requests for support, to maintain and repair the Services, and to detect, investigate and prevent misuse, fraud and security incidents;
  • to measure visits to our public pages and the effectiveness of our marketing; and
  • to comply with applicable law and to establish, exercise or defend legal claims.

We do not sell personal information, and the Services do not display third-party advertising.

5. How personal information is disclosed

Other users of the Services. In accordance with the privacy settings in effect for an account, a player's name, profile details (such as age, position, level of play, height and jersey number) and training activity may be visible to the coach of a team that the player has joined, the player's name, points and level may be visible to other members of that team, and the player's display name, points, level and achievements may be visible to other account holders on public leaderboards and player cards. A coach whose team a player has asked to join may see the name and email address of that player. Where a family plan is purchased, the purchaser may see the names of the family members covered by the plan. Leaderboards and player profiles are not accessible to persons who are not signed in to an account.

Service providers. We engage third parties to perform services on our behalf, including Google (cloud hosting, database, authentication and, where used, web analytics), Cloudflare (storage and delivery of videos and images), Resend (email delivery), Stripe (payment processing), Microsoft (business email), and contractors in Canada who provide software development and marketing services to us. These service providers are given access to personal information only to the extent required to perform their services and are required to use it only for that purpose, except that our payment processor and our analytics provider may also use information for their own purposes, such as fraud prevention, security and compliance with law, as described in their own privacy policies.

Legal requirements and business transfers. We may disclose personal information where we are required or permitted by law to do so, including in response to a court order or a lawful request from a regulatory or law enforcement authority, or where disclosure is necessary to protect the safety of any person. In the event of a merger, acquisition, financing or sale of all or part of our business, personal information may be transferred to the other party to the transaction, on the condition that it continues to be handled in accordance with this Privacy Policy.

6. Cookies and analytics

The Services use the local storage of the browser to keep users signed in, to remember their settings and to support the sign-up process, and our payment processor may set its own cookies on its payment pages.

We may use Google Analytics on our home page, our mailing list page, our sign-up pages and, where paid plans are offered, the page on which a plan is selected, to measure visits, subscriptions and sign-ups and to understand how visitors reach us. Google Analytics is not used on any other part of the Services and is activated only where the visitor accepts cookies through the notice displayed on those pages. We set one cookie of our own to record that choice, which may be changed at any time through the "Cookie settings" link at the foot of our home page.

Where Google Analytics is activated, Google sets its own cookies and receives information such as the pages visited, the referring website, campaign information contained in the link followed, browser and device information, IP address and a cookie identifier, and we may report to Google that a visitor has subscribed to the mailing list, created an account, started a trial or made a first payment, including the plan and amount. We do not send Google any name, email address or date of birth, we have disabled Google's advertising features, and Google retains visit-level data for 14 months. Information on how Google uses this data is available at policies.google.com/technologies/partner-sites.

7. Your choices

An account holder may at any time, under "Contact & privacy" in the profile, choose whether the player appears on the coach dashboard of the player's team, whether the player appears on public leaderboards, and whether training-related communications may be sent. A player's leaderboard display name may be changed or removed in the profile.

A subscriber to our mailing list may unsubscribe at any time by following the unsubscribe instructions included in our messages or by contacting us, and we will give effect to the request within 10 business days. Service communications relating to an account, such as password resets and billing notices, are not subject to these choices.

Consent to the collection, use or disclosure of personal information may be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice, by changing the settings of the account, by deleting the account or by contacting us, although withdrawal may mean that we are no longer able to provide some or all of the Services.

8. Storage and processing outside Canada

Personal information is stored and processed primarily in the United States, where the servers of our principal hosting provider are located, and may also be processed in other countries in which our service providers operate, including through the content delivery network that delivers our videos and images. While personal information is outside Canada it is subject to the laws of the jurisdiction in which it is held and may be accessible to the courts, law enforcement and national security authorities of that jurisdiction. Questions about our use of service providers outside Canada, and requests for written information about our policies and practices in that regard, may be directed to our Privacy Officer.

9. Retention and deletion

We retain personal information for as long as the account to which it relates remains open and, after that, for as long as is reasonably necessary to fulfil the purposes described in this Privacy Policy, to comply with our legal, tax and accounting obligations, to resolve disputes and to enforce our agreements.

An account may be deleted at any time from the profile, and deletion cannot be reversed. On deletion we remove the account and the profile, training information, preferences and team membership associated with it from our active systems, and any paid plan associated with the account ends at the close of the billing period already paid for. Copies may remain in backups and logs for a limited period, generally up to 30 days in our own systems and up to 180 days in those of our authentication provider. Certain information is retained after an account is deleted, including records of paid plans and transactions, records of invitations and other messages sent through the Services, and mailing list subscriptions, which are maintained separately from accounts and continue until the subscriber unsubscribes.

10. Security

We maintain technical and organizational safeguards, appropriate to the sensitivity of the information, that are designed to protect personal information against loss, theft and unauthorized access, use, disclosure or modification. These include encryption of information in transit between a user's device and the Services and of our database at rest, restriction of database access to a private network, and limitation of access to the personnel and contractors who require it to operate and support the Services. No method of transmission or storage is completely secure, however, and we cannot guarantee the security of personal information. Where a breach of our security safeguards creates a real risk of significant harm to an individual, we will notify the affected individuals and the Office of the Privacy Commissioner of Canada as required by law.

11. Access, correction and complaints

Subject to the exceptions provided by law, an individual may request access to the personal information that we hold about them and may request that it be corrected. Most profile information may be reviewed and corrected directly in the account. Other requests, including a request to change the email address associated with an account or to obtain a copy of the information we hold, may be made in writing to our Privacy Officer and will be answered within 30 days or such longer period as the law permits, at minimal or no cost. We may require information sufficient to confirm the identity of the person making a request and, where a parent or legal guardian makes a request on behalf of a minor player, that person's relationship to the player.

An individual who is not satisfied with our response may file a complaint with the Office of the Privacy Commissioner of Canada (priv.gc.ca) or, where applicable, with the Office of the Information and Privacy Commissioner of Alberta (oipc.ab.ca) or of British Columbia (oipc.bc.ca).

12. Changes to this Privacy Policy

We may amend this Privacy Policy from time to time. The current version will be posted at axisstickhandling.com/privacy together with its effective date. Where an amendment materially affects the personal information we collect or the persons to whom it is visible, we will give notice to account holders by email or through the Services before the amendment takes effect and, where required by law, will seek consent. Earlier versions are available on request.
